PURPOSE
Provide guidance to staff as to the acceptable practice of transporting clients.
POLICY
DBS staff is encouraged to transport clients in state owned vehicles for the purpose of official business as it relates to the Division and the client’s rehabilitation program. The State of Florida will be responsible for insurance coverage on individuals riding in state vehicles for this purpose.
However, transporting clients in personal vehicles will be at the staff member’s discretion and their personal automobile insurance will be utilized for coverage. It is highly recommended that other forms of transportation be considered. A counselor who does choose to use their personal vehicle to transport clients is entitled to reimbursement of travel expenses under s.112.061 as an employment condition. This does not convert the vehicle to a ‘vehicle for hire’, as ‘vehicles for hire’ are commonly regarded as means of public transportation.
The Division and the State of Florida will not be liable in case of incident or accident that occurs in personal vehicles as this is a stated specific exclusion in the state’s automobile liability certificate of coverage.
This policy extends to volunteers engaged in the business of the division.
